Joseph J. Flanagan, an associate of the Firm, is an employment litigator and counselor. As a litigator, Mr. Flanagan represents employers in federal and state courts on a wide range of employment law issues including:
• Discrimination, harassment, and retaliation,
• Employee policies, procedures and handbooks,
• Employment contract disputes, and
• Wage-and-hour.
As a counselor, he advises businesses of all sizes on employment law issues such as:
• Leaves of absence,
• Discrimination complaints,
• Wage payments or deductions,
• Employment policies, and
• Background checks.
Mr. Flanagan also focuses on workplace harassment or misconduct investigations.
Prior to joining Ellenoff Grossman & Schole LLP, he represented businesses on all facets of the employment relationship at three global law firms: two focused entirely on Labor & Employment law, and one provided a range of legal services in addition to Labor & Employment.
In 2025, Mr. Flanagan was recognized as a Best Lawyers: Ones to Watch in America™ for Litigation – Labor and Employment. In 2023, he was awarded the U.S. District Court for the District of Delaware Judge Caleb R. Layton, III Service Award for successful pro bono representation.
Mr. Flanagan graduated from Hofstra University Summa Cum Laude with a Phi Beta Kappa membership and received his Juris Doctor from Georgetown University Law Center.
